The eighth Amendment has a host of moral concepts embedded in it:

Jews, and to a lesser extent, Catholics, until the end of World War II, faced any number of social and economic restriction in employment, housing, education, and access to various social amenities. The demise of those restrictions, both by action of law and, more importantly, by changes in social thought, has greatly empowered the Jewish (and Catholic) communities. That occurred not only because government became more active in protecting civil rights, but because religion became less salient in screening access to important social and economic institutions.

Democratic morality acknowledges that all persons have full claim to the attention of the system.

A number of theorists stress that one reason collaboration works as well as it does is that it empowers participants and creates a sense of ownership and "buy-in" within the group. When decisions are reached, they are the products group's own efforts. The firstis whether the rules of a game make it sufficiently interesting to generatethe desire to play it or to watch it. (In regard to professional sports,a corollary consideration is whether the game is interesting enough thatfans will pay to watch it or that sponsors who want access to spectatorswill pay for the game to be played.) The rules must themselves be fair in somesense that conforms to the intuitive ideal of the game. I will explainboth of these ideas.

The basic ideas behind all these approaches is that people will knowwhat is best or right for themselves by understanding what they themselves(would) desire, and then they will use that knowledge, in one form or other,to do what is best or right for others or for all, or in the case of majorityrule, will do what is right for the most people -- sometimes in the mistakenbelief that what is best for the most (in the sense of a majority) is thebest plan that could have been implemented for all. For example, if wehad five people among whom to divide $300,000, it would clearly not bebest for all five (in a reasonable sense of "best for all") if three ofthe people (that is, the majority of the people) voted to give themselves$100,000 each and the other two, the minority of the people, nothing. Whatis best for all together is not necessarily the same as what is best forthe most (or majority) of them. The phrase "greatest good for the greatestnumber" is ambiguous. One should not therefore believe that majority interestis the same thing as the public interest. (See also, my essays about thissort of thing at and at .)

To this end, Khatchadourian says that even forms of terrorism that are designed to bring about a moral good are wrong because of the methods used to achieve that good.

Some argue in addition that the above effects on character tend toenhance the quality of legislation as well.
